Abstract: A new and distinct apple tree named `Nicoter`. The new variety is the result of a cross between `Gala` and `Braeburn,` and is most similar in appearance to `Gala`. The new variety is distinguishable from `Gala` by its red coloration and slightly less conical shape.
Claim: I claim:

1. A new and distinct apple tree plant named `Nicoter`, substantially as illustrated and described herein.
Description: Latin name of thegenus and species of the plant claimed: Malus communis Mill.

Variety denomination: `Nicoter`.

BACKGROUND OF THE INVENTION

The present invention relates to a new and distinct cultivar of apple tree, botanically known as Malus communis Mill. and hereinafter referred to by the name `Nicoter`. This new and distinct cultivar was bred by inventor, Johan Nicolai, inSint-Truiden, Belgium.

`Nicoter` originated as a controlled cross between `Gala` (unpatented) and `Braeburn` (unpatented). It most closely resembles `Gala` in appearance, although fruit of `Nicoter` is less conical in shape than that of `Gala`, and the coloration of`Nicoter` is more pink and less red than `Gala`. Additional differences are shown in the table below.

TABLE-US-00001 Characteristic `Nicoter` `Gala` `Braeburn` Fruit Skin color Yellow Yellow Green (background) Overcolor of fruit Red, pink Orange red to bright Red, striped red, striped Flesh Color Grey, slightly Red brown Red brown brown

The new variety `Nicoter` has been asexually propagated by T-budding and bench grafting onto `M9` and `MM111` rootstocks in Sint-Truiden, Belgium, and has demonstrated that the combination of characteristics as herein disclosed for the newvariety are firmly fixed and remain true to type through successive generations of asexual reproduction.

BRIEF DESCRIPTION OF THE PHOTOGRAPH

The FIGURE illustrates the fruit of the new variety, `Nicoter.`

DETAILED DESCRIPTION OF THE VARIETY

The following is a detailed botanical description of the new and distinct variety of apple tree, based on observations of specimens grown in Sint-Truiden, Belgium. The observed plants are four years old. Colors are described according to TheRoyal Horticultural Society Colour Chart (R.H.S.), except where general colors of ordinary significance are used It should be understood that the characteristics described will vary somewhat depending upon cultural practices and climatic conditions, andcan vary with location and season. Quantified measurements are expressed as an average of measurements taken from a number of individual plants of the new variety. The measurements of any individual plant, or any group of plants of the new variety mayvary from the stated average.

All trees of `Nicoter`, insofar as they have been observed, have been identical in all the characteristics described below. Parentage: `Gala` (unpatented) and `Braeburn` (unpatented).
